The FDR is a hearing whereby negotiation and compromise are strived for through pre-hearing discussions as well as with the Judge offering a view by way of an indication as to what the Judge might consider a reasonable result for the Parties.
The FDR is a hearing where some issues can be explored with the Judge and the otherside, as well as narrowing of issues that will remain for determination if the case proceeds to a trial. Preparing documents for such a hearing for use throughout the negoitaions is of central importance (see PD27A)
Expert representation is an advantage at such hearings as the hearings can be very informative as to exposing the otherside's stance on a host of issues and principles. Any weaknesses exposed in your case can be worked upon pending the Final Hearing to ensure your case is best prepared for the eventual determination.
Having an experienced Divorce Barrister represent you at the FDR also provides the opportunity for any settlement to be drafted into an Order or Heads of Agreement such that the matter has best chance of being concluded without the need for the Final Hearing; Drafting skills are not to be under-estimated as there is often great debate and argument as to the finer details, even once the main areas are resolved!
